The US District Court in the Northern District of Ohio, Toledo branch has ruled that Ohio's provisional ballots can be cast by voters at the wrong precinct. The decision can be read here (PDF). Ohio Secretary of State Blackwell has already filed an appeal to the 6th District Court of Appeals....and more stuff here. Lots of links and legal stuff. How does this facilitate fraud? Why shouldn't people, often first time voters, be allowed to cast a provisional ballot from a different site? Are you assuming that somehow the poll site coordinators would know who this person is before they cast the ballot? Are you worried about someone voting in two different places? The latter would be caught in most states. I understand the picture ID argument; requiring them would actually prevent more fraud. But not allowing provisional ballots at the wrong poll site just smacks of trying to drive down voter participation, especially of new registrants. What mechanics are in place to dissallow me from voting in every precinct in the state if I would want to????? These judges absolutely circumvent legislation and existing laws by making up their own as they go. Especially if it will favor the Liberals who display less regard for the laws if it gains them power. These same forces are at work to impact the elections already with false implications of voters being barred from voting stories with no basis in fact already. This is actually encouraged by the DNC instructions. Lets work to stop the Liberals from stealing an election as they nearly did 4 years ago. This type of jurisprudence has got to be stopped by making common sense appointments of judges who interpret the laws, not devise new ones. Posted by: Mr. Fixit at October 16, 2004 03:51 PMWhen I was in college I once worked as a 'poll watcher' because even though students had gotten court approval to vote at their college residence, some of the locals didnt like it a bit. First time voters would come in to the gym and there would be 6-12 tables there, each a different district. I happened to have a map of the wards and districts with me, but the pols didnt want me showing it to the first time voters. They would just tell the kids, 'no, your name isnt in the book' and hope that they would go away without voting, even though their name was in the book 20 feet away. If it comes down to the provisional ballots, and they see your name as having voted in every precinct, they'll throw out your provisional ballots.
