In a letter to the editor in today's Nashville City Paper, a a reader/writer named Kenneth Joyner reports that his wife was ticketed for driving in the high-occupancy-vehicle lane even though she had the required two people in the car. Here's an excerpt of his letter: My wife was stopped by a Metro police officer for an HOV lane violation but she was not alone in the van. In fact, my 4-year-old daughter was with her and, yes, she was strapped into her child restraint seat.The police officer was wrong about the law governing use of the HOV lane. I have been stopped twice while driving in the HOV lane on I-65 south of downtown Nashville with one of my children in the car. Once, with my daughter, then age 3, and the other time with my son, an infant. Both times, the state trooper who stopped me let me go after seeing the child - which he couldn't see from inside his car. The law is clear - the HOV lane is for vehicles with two or more people, period, not just for people carpooling to or from work. Tennessee Code 55-8-188 says: "High occupancy vehicle" means a public transportation vehicle; privately owned bus; motorcycle; private passenger motor vehicle (including vans and pick-up trucks) carrying not less than two (2) passengers, or more as determined by the commissioner of transportation."Fight the ticket, Mr. and Mrs. Joyner - the Metro cop was wrong. UPDATE: The Nashville area has something called the "Regional Transportation Authority," which encourages carpooling, provides commuter shuttle services and is pushing mass transit proposals. The RTA's website explains that the HOV lanes are for any vehicle with two or more people in it, saying, "For HOV purposes, a passenger is any human being in addition to the driver. A spouse or child qualifies just like any other passenger." Posted in Miscellaneous

Isn't the intent of such laws to cut down on the number of cars driven on the expressways by a single person? Hauling children in car seats, therefore, does nothing to alleviate the problem addressed by the law. I agree, however, that without specificity, she did not violate the law. Posted by: SemiPundit at June 7, 2004 11:36 AMI suppose it may vay by circumstance (and by state), but HOV lanes in Los Angeles are actually a major contributor to congestion and pollution. They actually lower the throughput and capacity (by car and by person) of the highways that have them. The driver's seat would be pretty crowded. B-) You are probably right that to meet their alleged goals HOV lanes should be restricted to vehicles with passengers who have driver's licenses, but the law should be enforced as written -- not as some random policeman wishes it had been written. If the officer refuses, call the police on your cell phone and explain the situation, and demand that the supervisor come out. Supervisors don't like to come out, and I guarantee that this won't happen again. As for this lady, she needs to go file a complaint and follow it through. Nothing will happen unless she follows it through. Writing to the City Paper isn't going to accomplish anything. Seems like you need a driver and at least two passengers. That's three people minimum in the vehicle. Therefore, two people (driver + one passenger) means you're in violation. Or can I simply not count very well? Better buy a few blow-up dollies.
