« Who? | Main | Adventures in the Land of Lincoln » July 13, 2007Small Town NewsInteresting public records access story in the Cookeville, Tennessee, Herald Citizen today: "An Internet journalist who says he was denied access to public records in Livingston has filed a court petition asking a judge to order that access." Read the story carefully and note that while the city attorney insists OvertonJournal.com publisher Joseph Edwards was not denied access to public records, the county attorney very noticeably doesn't deny the second part of Edwards' allegation - that he was told he could have access to the court records only if he agreed to let a judge pre-screen his stories before publication. Guess that judge slept through the prior restraint chapter in his Constitutional Law class. Posted by: jo at July 13, 2007 9:42 AMIt's too bad that the open records laws in TN are so weak--in many states the clerk denying his request would have been violating the law by demanding to know who he was and what he planned to do with the documents. Fact is, these are public records, and everyone is entitled to see them. Posted by: Sara at July 13, 2007 11:31 AMPost a comment
