Anti-Blogger Legislation Would Have Violated Federal Law, Expert Says

Legal expert Jack Balkin looks at legal issues raised by proposed state laws - including the anti-blogger legislation pushed by Tennessee state Sen. Jamie Woodson and state Rep. Rob Briley - that would hold bloggers responsible for defamatory statements made on their websites. The "notice-and-take-down" obligations of those proposed laws and the provisions that hold bloggers legally liable for defamatory comments posted by readers, would violate federal law, he says.
