The Western Section Court of Appeals ruled that term limits are a "qualification" for holding office, and that only the Legislature can set such qualifications. In delegating that power to the counties throught the charter process, the COurt ruled, the Legislature violated the constitution. The Court didn't hold term limits to be unconstitutional per se, only that they may only be imposed by the legislature. This ruling should NOT affect Metro Davidson or any municipality, such as the City of Knoxville, that has adopted term limits. Cities are governed by a different section of the Tennessee Constitution (Art 11, Sec. 9)than counties (Art. 7, Sec. 1), and have much more latitutde in setting the qualificatiuons of city officials than do counties.
