Part of the Problem

Alan Dershowitz is right: The Geneva Convention has become the terrorists' best friend.

Without haviung read his column, here's a couple of comments;

First I find it interesting that he's saying the rules set up to protect the 'oppressed minority' are overkill. I can only assume his change of heart on this occasion has something to do with Israel being in the crosshairs of the terrorists.

Second, I said this about Bill Clinton and it applies tpo terrorists as well. A law is only effective if people are upstanding enough to uphold it. Will someone please explain to me how a terrorist could ever fit into such a mold? Short of an answer on that, we must assume that the rulebook is hindering us in our fight to survive.

Despite its status as the Holy of Holies, the Geneva Convention was written a long, long time ago in a vastly different era for a vastly different, far more symmetrical form of warfare.

But you know, it does make me think that perhaps developing a new Geneva Convention for a new era would be a smart idea.

My own belief is that we should either adhere to the Geneva Conventions or abrogate them.

We simply aren't adhering to the Conventions with respect to the Guantanamo detainees. Regardless of their status as combatants, non-combatants, or illegal combatants under the Conventions they were entitled to a hearing to determine their status. That hasn't been done.

Cherry-picking is a poor policy and that's what we're doing.

The additional problem is that even the signatories we've confronted in the last 25 years haven't adhered to the conventions. So I believe we should abrogate the Conventions or at least announce our intention of doing so without revisions.

Fine. Let's have a military tribunal to determine their status. Since they are not legal combattants, they can be summarily executed once their status is determined.

i was wondering if i could get a copy of the article written by Alan Dershowitz titled "the outdated Geneva convention" i was unable to get the full artilce and when i clicked on view full article the page request was not available. if i could get an e-mail copy or a site that contains the full article i would appreciate it. thank you. my e-mail is roofisrocks@yahoo.com
